Terms of Service

1. These terms

These terms govern your use of zenithoutbound.com. They are not the agreement under which we deliver services. Paid engagements are governed by a separate written services agreement signed by both parties, and where that agreement conflicts with these terms, that agreement prevails.

2. What this website is

This site describes our services and lets you book an introductory call. Nothing on it is an offer capable of acceptance, and nothing on it forms a contract. Descriptions of our process, team structure, and inclusions are indicative and are confirmed in writing during scoping.

3. Booking a call

Booking a discovery call creates no obligation on either side. You may cancel or reschedule at any time using the link in your confirmation email. We may decline or end an engagement discussion where we believe our services are not a good fit.

4. No guarantee of results

Outbound performance depends on factors outside our control, including your offer, pricing, market conditions, competitive position, and how quickly your team follows up on the meetings we book. We do not guarantee any number of meetings, any volume of pipeline, or any closed revenue, except where a specific commitment is written into a signed services agreement. Any figures shown on this site are illustrative unless expressly identified as a contractual commitment.

5. Engagements and payment

Scope, fees, invoicing schedule, and notice periods are set out in the services agreement for each engagement. Unless that agreement says otherwise: fees are quoted exclusive of applicable taxes; invoices are payable within [14] days; and either party may terminate on [30] days' written notice. Third-party costs such as sending tools and contact data are billed to you at cost and remain your property.

6. Your responsibilities

• Provide accurate information about your offer, market, and qualification criteria.
• Review and approve target lists and message sequences before launch.
• Attend, or promptly reschedule, the meetings we book.
• Ensure that any data you provide to us may lawfully be used for the purposes of the engagement.

7. Intellectual property

The design, copy, and code of this website are owned by Zenith Outbound and may not be copied or reproduced without permission. On completion of an engagement, target account lists and contact data built for you remain yours. Our underlying methods, templates, frameworks, and tooling remain ours.

8. Confidentiality

Each party will keep the other's non-public information confidential and use it only for the purposes of the engagement. Where we reference an engagement publicly, we do so only in anonymised form unless you give written permission to be named.

9. Compliance

All outreach we send on your behalf is business-to-business, identifies the sender, includes a valid postal address where required, and carries a working opt-out honoured promptly. We maintain a suppression list across all campaigns. We will not send outreach that we believe breaches applicable law, and we may refuse instructions that would require us to do so.

10. Liability

Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud. Subject to that, and to the extent permitted by law: we exclude all implied warranties; we are not liable for loss of profit, revenue, anticipated savings, business opportunity, or data; and our total aggregate liability arising out of an engagement is limited to the fees paid by you to us in the [3] months preceding the event giving rise to the claim.

11. Third-party services

This site embeds a scheduling widget provided by Calendly and links to third-party sites. We are not responsible for their content, availability, or practices, and your use of them is governed by their own terms.

12. Changes

We may update these terms. The version published on this page at the time you use the site is the version that applies.

13. Governing law

These terms are governed by the laws of [JURISDICTION], and the courts of [JURISDICTION] have exclusive jurisdiction over any dispute arising from them.
